I see it as 2 part:
The copyright laws need changed so companies don't feel like they have to defend IP from non-profits for games or services no longer supported or offered. Examples of this that are easy is a console game that gets refreshed every year such as sports. Eventually the old online servers are taken down. This also encompases our favorite World of Warcraft. There needs to be a space for non-profits to operate in this area. Its a nod to the developer, its a constant reminder of their greatness.
Either that or try the legacy route Blizzard. I would want Vanilla preserved with the option to transfer to TBC then preserved and the option to transfer to WotLK. Part of the draw of private servers is the talents, gear etc don't change. You can become powerful in your expansion and continue enjoying the power. I would like to see this as an option.
