Actually as far as I know, Molten-WoW did actually receive a take down notice and supposedly has had a LOT of controversy between legal groups and their hoster's and staff.
I believe the servers are actually down now.

It may fall under Abandon Ware, but their title "World of Warcraft" still falls under copyright law (still paid by Blizzard) so essentially, using their client, initials (WoW) or even the term "World of Warcraft" anywhere on the site/game is a breach to their copyright and they can issue a take down notice. Seeing as the servers are hosting an older client, they still, do unfortunately use their copyright without permission.
People believed that Molton-WoW and Blizzard came to a "understanding", but that was never true, and It'll be like this for this server.
I forever hope that this server never goes down. Especially the technology used and made for it. To host 9 thousand people on-line at once (even Blizzard can't do that) is astonishing. Maybe, Blizzard might learn something.
