Why hasnt this server received a DMCA threat yet

several other servers, also located in EU have already made contact with blizzards strict DMCA policy. There was already a partial twitch raid targeted at private server streamers resulting in 24h mutes. Strange things happen these days. I just wonder why blizz hasnt done anything against the undisputable and most successfull private server of all time in therms of population (and scripting that made everything possible).

Blizzard just doesn't really give a fuck anymore. Look at Molten-wow. Big community. Up for years.
New servers pop up faster than they can take them down is also a possibility.

I would like to know which servers have gone under to Blizzard DMCA that were located in the EU.

DMCA doesnt apply in Europe.

Takedowns have to be in complaince with European / local law

Who says Nostalrius hasn't received a DMCA threat yet? Maybe they have and maybe they just don't give a crap. Businesses send out tons and tons of DMCA threats all the time, many of them in frivolous manners that are never acted upon.

Just because one receives a DMCA threat doesn't necessary mean the entity will follow through with it. The DMCA is an American law and is a legal nightmare to issue a takedown that is in compliance with European law.

if the server isn't setup to make profit out of it Blizzard doesn't really care that much

What LYQ said, Nostalrius is special in that they don't have to deal with the legal side of exploiting Blizzard's intellectual property for profit.

It's like making a parody song, you can tell what it is but you can't get in trouble for it.

You are all making it sound like EU are some kind of exodus for criminals like Cuba and such. Most countries in the EU have agreements with the US, so that criminals can be send there and tried. Hence why Assange (the Wikipedia guy) are in asylum in that 3rd world embassy (because Sweden where his alleged crimes are commited, will most likely send him to the US). There are many cases as such - The Pirate Bay being the most prominent. So to say, this server is safe for all eternity, would be foolish. All we can do, is to enjoy the moment.

I'm not sure where you're getting this from. I don't think anybody is saying you're immune from all forms of the law just for hosting something in Europe. Rather, the litigation behind it is just enough of a hindrance that it doesn't make it worth pursuing for Blizzard, especially if the server isn't making profit.

Blizzard have had a tendency of seeing through fingers with non-profit private servers in the past, but with the way subs are declining and the succes of this server (which they must have noticed) - they just might see it worth their while to set an example (they did so with the botting issue recently, even if they just lost a lot of subs). We also haven't had any clarification, how they (Nos) are going to fund it moving forward (hardware, manhours etc); even if they just break even, transaction of money would still be made. Legal wise a server being based in the EU, isn't the huge legal hurdle everyone is making it out to be. Don't get me wrong; this is the best thing since sliced bread and I hope they let us have our fun.
