Dodge from Behind? Backstab fleeing targets?

I didn't play rogue much on vanilla... so I have a couple questions:
Are enemies supposed to be able to dodge from behind?
I have trouble backstabbing fleeing targets, which doesn't seem right because their back is definitely to me... is this a bug or intended?

Mobs can dodge even when attacked from behind.

From behind, mobs cannot parry or block attacks.
They can however dodge, and you can miss (weapon skill vs enemy level)

I know for a fact that I have successfully used BS on fleeing targets... It can be a pain to stay in range if you didn't react quickly enough, but you can definitely backstab a fleeing target

This is an instance where having run speed on your boots is useful.
