Pivko use bug in battle ground

Dear GM:
does it legal to use mind control in battle ground then type /afk?
my friend supermars have been been controlled by pivko in battle ground sever times
and force to leave the battle ground before the battle finished.
then he got a 15min debuff and can't queue the bg.
does it legal gm team?
