Ninja looting isn't against the Terms of Use.
It's frowned upon by the community though.

Physical Harassment
The sole purpose and intent in any action used to upset, aggravate, or otherwise annoy another player may be considered physical harassment.

Verbal Harassment
The player that managed to ninja the item was continually egging me on.

Physical Harassment - Denied
Ninja looting is an offense. The party leader has the ability to set the loot threshold and the loot type of the party. The descriptions you're reading in the client and the Terms of Use (https://forum.nostalrius.org/viewtopic.php?f=2&t=8) are two different things. One is from Blizzard, one is from Nostalrius Begins. There's a reason why this thread exists.

Verbal Harassment - Denied
The staff strongly supports the use of in-game tools which you have presented here. Using the ignore function is strongly suggested to people who aggravate you with 1 character. If there are more characters of the same person and you have to ignore them all, the staff will most likely handle it if you send a ticket in.
