I think they should change their policy. In a situation like this characters who have never been logged into, are banned, been inactive for a long time AND aren't a high level, or are under a certain total play time/level (example: below level 5, only has 3 items, only played for 24 minutes), should be deleted or at the very least have their names changed.
I don't think you realize the frustration of spending hours picking a name for your character because damn near everything common and even uncommon is taken/saved.

In retail it was also a lot less common for people to save a bunch of names as well.
A final note, it is actually very Blizz-like to give the names of these level 1 bastard children to active players seeking to use them. I really can't see any reason why Nostalrius would not be able to do the same.
