AoE Bug?

So Today I was in Gadgetzan and got killed miltiple times by only a lvl 48 mage(Had rez sickness) however becasue he was using an AoE spell Blizzard he wasn't being attacked by guards even though he was stood next to one, I always thought that doing that provoked them into attack? If I am wrong delete this but if any Proof is needed I do have 2 Screenshots of him doing it both at the start of blizzard and then near the end, in which he didn't aggro anyone. (ALso noticed a hunter do this with Arrow volly)
