It's not cheating, hacking, abusing the game mechanics (Hell, it's a Rogue for god's sake), but the basic style of playing a rogue.
Not bannable. Every rogue has pickpocket farmed SM and LBRS at one point in their playtime. It's a good source of income.

P.S yeah, I *did* read the rules, but you can render it both ways. since picking pockets *is* an advantage for rogues that no other class gets == bannable, BUT it's also a basic skill rogues have == clever use of game mechanics.
The only mass ban of rogues was when the lockboxes had a high drop rate on epic quality items and rogues were abusing this to make a profit off of the lockboxes pickpocketed from the mobs. Other than that, you should be free to do as you please because you only get 5 instance resets per hour. Mobs that have been pickpocketed cannot have their loot table regenerate so after you take the silver and other items during the pickpocket process, the mob is basically useless if you don't kill it.
Just some clarification on why pickpocketing isn't bannable:
I'm a mage and if you do: /who z-"Dire Maul" c-"Mage" 58-60 -- you would see a lot of mages in Dire Maul East farming the Whip Lashers. We're using AoEs to farm them for about 7-20+ gold per 5 instance resets. As far as I know, the 11 other mages that I know have not been banned by doing this because it's not abusing a game mechanic at all. It's doing what this was intended and playing by the rules of the 5 instance resets per hour.
