You should not have any problem playing on the same network. I play with someone else in the house sometimes and we do not have a problem.

No seriously, if you and your brother are each playing from your own computers logged into your own accounts playing your own characters, you'll be fine. Only when one of the characters is /following the other character for a long period of time and activity between the two resembles alt-tabbing behavior (One kills then stops, the other moves and loots then stops, the other begins moving, etc.) would flag you as potentially multiboxing.
