I never said Blizzard would go after the publicly released version of Nostalrius, nor the basic default server that anyone can get, nor anyone who tries to improve on it. I said that if Blizzard were to open a court case against Nostalrius to shut it down. If the court case opens, then the case is essentially won by Blizzard by default due to past decisions in court. It might take months, even years but the end result is still the same.

While the court case is open, it would be illegal for Nostalrius to release their server data to the public. If they did release it, Blizzard would sue the hell out of everyone involved in the Nostalrius project, not to mention law itself would go after them for releasing the data. Blizzard wouldn't try to shut down the released data because it would already be out there. But if Blizzard wins, all the server data is confiscated and lost. Of course anyone can re-do the years of work that Nostalrius did and make a 7000 population server again, but why risk sending a server and community down the drain for a few donations.

Therefore, it's better to keep the server free. So that Nostalrius doesn't earn any money from content owned by Blizzard, so that Blizzard doesn't try to shut it down.

Yeah, I misunderstood entirely. Thanks for clearing that up. As for the emulator and database, I'm pretty sure there is a backup server for both DB backups and an archive for the emulator. I have my fingers crossed that Viper or Daemon has a local backup even if its a week old.

all correct if they were in the US, however it's not which makes this void.

Not true at all. DMCA still has forms you can fill out to request a takedown outside of the US. Since it's a US law, there's a small chance that Blizz can touch Nostalrius... still a chance though.

The US and European Union are cooperating when it comes to copyright infringement, DMCA takedowns and much more, but here's some common ones, incl but not limited to: Denial of Service, Distributed Denial of Service, Hacking/Cracking into a international service/system, Fraud and even death threats. Sure the US can't send police to kick down the door at the Nostalrius server host, but they are without a doubt able to send the respective police in that country to do so once the court has ruled it. Anyway, no point to discuss this further.

Nostalrius isn't a charity organization. Therefore there's no way that Nostalrius can legally get donations to run the server costs. It would be considered selling/earning money through Blizzard's content, whether it's by donations or fee's doesn't matter, legally anyway. Personally, I kinda like it this way, means that they're not doing it for the money, but to have a proper server and a good community.

And everyone here has to admit, they're doing a freaking amazing job.
Edited: Made myself misunderstood, I need to stop hasting responses :P

For those who are unaware, there was a call for donations back in March when the population started ramping up.

The cost of this hardware cannot be handled by our team alone, therefore a donation system will be available for a limited time (and limited cost) here. This donation will not be mandatory, nor give any reward: No hall of fame, no items in-game, it will only help us support the upkeep cost. A status of the donation will be available on the website.
