2) Yes, it is bannable on retail if extensive enough.

Whenever there's a way for players to resolve a situation themselves we prefer to not get involved. On a PvE realm it's opt-in, so if you get killed you essentially asked for it. If you're playing on a PvP realm you opted-in permanently, so again you essentially said that being attacked unexpectedly is okay.

It's a two way street - if you want the possibility of PvP then you have to accept that you may get 'ganked' now and then. If it's not working out for you, the only option is to move to a PvE realm or to hide in the capital cities. :)

That said, we don't abide is players deliberately trying to ruin the enjoyment of others; it is a game after all. If someone made it their mission to constantly kill another player (e.g., following them around and killing them whenever they're online, day after day, over a long period time), that could make it extremely difficult for the victim to play.

At that point it stops being PvP and becomes harassment. We'd want to hear about it and would, at the very least, look into the matter.

If someone is specifically targeting a player over a long period of time, we may look into the matter and it is possible that we would take action based on the situation. In most situations though, where a PvP solution does exist, we generally do not become involved.

If it has been going on for days though, feel free to submit a ticket and a Game Master can take a look.

I'm well aware this isn't retail, thank you for clearing that up. The point was that people are claiming since it was bannable on retail, it should be bannable here, when it isn't and never was bannable on retail.

Tracking someone for DAYS so they cannot play the game is vastly different from going to a quest hub and killing NPCs to inconvenience the other faction, people could even be doing it for RP reasons (Yes, you are allowed to RP on a PvP server, or private server for that matter).

This described case does not fall under the category of 'griefing' in any shape or form, period.
