I never claimed to be an expert of the law but, private servers violate copyright laws.

As for public domain I have no clue but a quick Google search tells me, "copyright term is based on the life of the author, and extends to 50 or 70 years beyond the death of the author."
In other words, Blizzard will never lose it's rights as long as they're in business. Just because people are capable of creating private servers and maintaining them for the small groups of people that enjoy them (myself included) doesn't mean they have legal rights to do so.
