I think many streamers of any private wow server got banned. Just tried looking up other private servers' streamers and they got banned too.

Since you're an expert on the law, at what point does a game become public domain?

Since Blizzard refuses to allow people to play a game they want to play and maintain themselves, at some point they will lose the rights to it.

When is that?

ok guys less unreasoned trashtalking about blizzard, and more usage of your brains.

Even if u make a private server advertisment on the retail forums, you do not even get a forum ban there (topic gets locked, you get warned, but that's it if u do it the first time)

overall blizzard chose to ignore private servers, unless the private server charges money to play on it.

It seems more likely that Twitch just got afraid of hurting possible copyrights and removes that content BEFORE the presumed copyright-owner doest act.

Youtube acts in a simular way for example, in special in germany. If there is only a far chance that your video possibly hurts any kind of copyright, your video gets blocked in germany.

it seems Twtich chose the same path now.

Read Twitch's ToS to see if you can stream servers that are emulated outside of the original game developer's servers. They reserve the right to shutdown your channel at any time even without Blizzard taking it up to Twitch anyway. It's a service that has it's own rules that are obviously influenced by companies so any action can be taken to shut your channel down.

Wrong. Donations for profit have been accepted as terms to sue a private server owner. Charging isn't the same as donating.

This is factually incorrect. There are 0 advertised servers in the United States. Blizzard sues them if they don't shut down when threatened. They have won millions of dollars, see Google.

This isn't how DMCA works on any corporate owned website in 2015. DMCA are all automatically executed through agreements with large corporations. Blizzard is certainly part of this agreement process, and has access to pull any stream they deem 'unworthy'. They literally have administrator access.

This is all Blizzard, Twitch is nothing but a sell-out streaming host in 2015, hence why they block all songs on VoDs. Twitch will eventually lose it's throne as people migrate to a free environment. (see Justin.tv .. ha ha)

Fucking sad really, that corporations do shit like this, but it's the world we live in.

As for public domain I have no clue but a quick Google search tells me, "copyright term is based on the life of the author, and extends to 50 or 70 years beyond the death of the author."

In other words, Blizzard will never lose it's rights as long as they're in business. Just because people are capable of creating private servers and maintaining them for the small groups of people that enjoy them (myself included) doesn't mean they have legal rights to do so.

A private server obviously won't be 100% Blizzard's coding as custom programming has to be done to accomplish many tasks. However, there's not 1 private server core that is 100% custom original code thus you will find a bit of copyrighted lines of code. Sure not every line of code Blizzard used is theirs as WoW was created in C and the interface scripting is LUA but, majority you can safely assume is theirs. Also, all the textures that make up the game are owned by Blizzard as well.
