A private server obviously won't be 100% Blizzard's coding as custom programming has to be done to accomplish many tasks. However, there's not 1 private server core that is 100% custom original code thus you will find a bit of copyrighted lines of code. Sure not every line of code Blizzard used is theirs as WoW was created in C and the interface scripting is LUA but, majority you can safely assume is theirs. Also, all the textures that make up the game are owned by Blizzard as well.

Reckless disregard for fair use laws. This is absolutely without merit. Fair use laws allow for this. If Blizzard is activating their "trap card lawyers" this is setting not only a new low but a dangerous precedence.
