My mining rogue is one of the ones that did NOT get banned. My hearth for that char is in Silithus, and I use it to mine the hives when i am not doing something else. If you've noticed i've been active on this subject that's why. So I thought I would objectively provide some additional facts since it might help here.
I went back in and did some mining yesterday and today, trusting in the Daemon's assertion that the problem has been fixed, and that people who mine now can do so safely.
On worker mob agro: The workers (they look like beetles) never agro on you, no matter whether they are red or yellow. They also do not agro if they are standing right on top of you while mining a node.
This works the same before and after the fix.
On non-worker mob agro: The reavers, etc. elites will agro on you of course if you are in range. A rogue can blind, gouge, etc. and mine, vanish, prep, repeat, etc. and mine anyway. These mobs also pat, and they will often pat out of agro range so you can often mine without using these cooldowns. There are only a few nodes where it is absolutely required.
This works the same before and after the fix.
On accessibility: A rogue can reach and mine every node. A druid can reach a large percentage of them easily. Other well geared classes can also reach a subset. Every node can be solo mined by rogues, and a subset by other classes.

On spawn time: Before the fix, Ooze-covered Thorium Veins spawned exactly 45 minutes after the last hit on it. This seems to be changed (although I haven't tested it thoroughly) I notice that the nodes seem to appear more 'randomly' though; that is closely linked nodes do not spawn close to the same time, which would happen before because they would always be mined together.
This seems to have changed.
On node locations: They are exactly the same both before and after the fix. No changes at all there.
On node availability: Before the fix, nodes were somewhat hard to come by at certain times of the day due to "industrial level" mining. After the fix, nodes are still hard to come by, but appear more randomly. It does seem like it's easier to mine however. I do actually like this change, by the way, because it seems to be more fair to all the miners there.
On mining there now: It feels pretty much exactly the same as before, at least for me. The only difference that I notice is the locations of live nodes seems more "random." And it seems like it's less likely to run into a competing rogue when you find a node (but it does still happen). Nodes are still pretty scarce as there are lots of miners still operating.
On knowing about some 'bug': I mined these myself starting several weeks ago when I dropped 300 herbalism (bcuz, no herbs!) for mining. I had no idea that these mines weren't working exactly as intended - after all 45 minutes spawn is quite a while, and reasonable. Many other spawns types are deterministic on this server, and nearly everything on every private server I've played has a deterministic spawn time for everything. I played retail since November 2004, but never mined Silithus at the time, so do not know if it was deterministic back then. I don't know if any other miners suspected a bug, whether they are in the banned set or are not. I just know that I suspected nothing amiss.
On how many accounts were banned: I saw lots of rogues continuing to mine Silithus today, both Alliance and Horde. By no means was "every rogue mining Silithus" banned. The ones I spoke to didn't even know that there had been a ban.
On my own activity (e.g. why was I not banned?): I mined there, but never systematically constructed a looped route and counted on the 45 minute timer to arrive at each node in the loop just before spawn. But I certainly THOUGHT about doing that, as it seemed like it might be an efficient way to mine. At no point did I think it would be any kind of exploit. I also never mined for more than a hour or so at a time (too boring). Also, I took a break for the past couple weeks to concentrate more on work. So I think I was just lucky, or not industrial strength enough.
TLDR: Just trying to provide some factual data from the perspective of someone who actually mines there.
