Where is the difference between being AFK in BGs that leads to a warning and leads to a permanent?

As i understand you give permanents to any, who AFK in BGs. So, it wasn't required to read and accept your ToC, since there are no rules that respect. Or maybe you've changed the policy and forgot to notify your customers?
