That's not an "if or". The only thing you could achieve is that the server get shut down, and opened again with a different name on another serverfarm.
"Your" chars will be gone forever. Period

Nostalrius staff can shut down any account at any time without any reason. This is their right, and it clearly says so if you take the time to read.

How anyone can think they would have a fighting chance in any court is ridiculous. Stop wasting their time and be glad they even took the time to look at your case.
