I disagree with the ilegal part, I bought the game 10 years ago and Nost weren't making any profit from it, so how is that stealing? (in your example you implied "for profit" as a point to be harmful).
To me it just comes down to an outdated law not including mmo's in the abandoware section.. blizz should have no right to deprive me from playing the game I already bought, they can stop offering the service themselves, but they can't ban people from playing it. I think of the mensual fee as a price to access quality servers, customer service, bug fixing and eventual content releases.
I still doubt Blizzard had any law basis to shut down Nost, dmca doesn't apply in EU afaik (I've tried to find any law changing this...)
