I remain hesitant about rolling on XXXXX private server, even though the plan sounds good. Why? Because I have no proof in my hands whatsoever that XXXXX can, and indeed will, resist a cease and desist order. As far as I know (I may be wrong), XXXXX is based in XXXXX, and, again from the little that I know, these countries provide the legal framework for Blizzard to go after XXXXX, should they want to. If this is true, it is, to say the least, very worrying.

You could replace XXXXX with the name of any private server, and have the same thoughts - basically, if you don't want to play there, don't. You won't be missed.

The only assurance that your char will live for years and years is to play retail.
To play on a private server we all willingly take the risk to loose our characters for multiple reasons.

I think that the magnitude of this risk that any server runs is proportionate to how successful it is. Hopefully, the Elysium-Nostalrius collaboration is going to provide the most successful cluster of servers yet.
