Now the facts: Everyone passed on the tiger when it was on group loot, thats acknowledging the fact that things went wrong and that it should not have been a completely free roll. Souldtapdat passed too in that occasion and therefore accepted the OTHER way of distributing the loot that was chosen by the guild. If he was a completely random guy and nobody told him a word beforehand, he could have just rolled need and it would not have been a ninja, however he passed!
So, the next thing, it has been proven that certain people were chosen to /roll for that item and you see guy X has the highest roll, therefore the item is bound to go to that guy X. The item was distributed, it belonged to guy X, since he had the right and the will to loot it.
Another guy though took the item, he didnt have the right to do so and he knew exactly that. Easy proof here:

Now not that this is needed at all, as stated above he acknowledged the guilds loot distribution upon joining the guild, joining the raid and passing on the item anyway.

Conclusion? This was an act of ninja looting.
What the GM's do with this case is up to them, the item in question is of insane rarity and value and an object of great desire, so taking care of this incidence doesnt mean that GM's have to take care of every single incident on the whole server. Its like in reality.. a certain % of all potential cases arent even reported or being taken care of after their report... way more than people think!
The question if ninja looting is bannable in the first place remains open. It would be ridiculous if it wasnt though! Lets all make pugs and switch to master loot in the last second to ditch the other 4 or 19 or 39 depending on the size of the group? If that behaviour is officially stated to not be bannable, it would become a huge problem leading to only well-known players being able to run pugs. You would always be in danger of getting thrown into a non-legit pug, a new guy starting up pugs and ninjaing loot, an old guy that only waited for that one TF binding or mount, or eventually even that alt of a well-known ninja host.
Tldr: Its ridiculous.
