On you're original point. I don't know if you have ever taken any self-defense classes, but the main key of self-defense is good cardio. Not so you can fight well, that is secondary, but so you can get the fuck out of dodge when things go bad. This is because, even if you're better trained, better prepared physically and mentally, there is a chance that you take one bad blow and you're a vegetable for the rest of your life.
This is pretty much what the Nost team is doing, they're getting the fuck out of dodge.

They could take this to court, the server would have to either be shutdown or moved (which would hurt their case, so the first is more likely) while they fight it. It would cost them a lot in lawyer fees and the like to even start. Then the case would more than likely drag on for a very long time costing them even more.
So unless they've got money coming out of the ears, it's a loss loss. We don't get to play while they're in court, they don't get to release server info as that'll hurt their case also and even if they do win, it is going to cost them a lot. But if they lose, they're going to get absolutely reamed.

This is them being like "Ok, It's gone please don't sue me so hard my arse will bleed".

They aren't filthy rich people. They funded this server with their own salraies. They can't afford fighting Goliath like blizz. It's not being a chicken.

No1 will put his/hers life on a stake for a fun-project. I mean it was serious project but video game based, which define it as fun. The biggest thing that devs are giving us is sharing a source and saving player data for possible future use. Just to remind you guys blizz sued a private individual for 88 mil $ in 2008 for running private server, would you fight that yourself to give 15k ppl a thing to do to kill time after a busy day or try to settle? Please don't be borderline retarded.

The guys behind the Pirate Bay got 1 year in prison and 3 million euro in fines for facilitated other people's breach of copyright law... The thing is that even if you are innocent these lawyers can ruin your life so I totally understand the reaction from Nostalrius. This is a lose/lose situation though. I don't understand how Blizzard is thinking.
