The Nost team have taken nothing directly from Blizzard, they have replicated. The coding is built from "scratch" and is theirs to do with as they wish. Imagine an artist replicating the Mona Lisa, you can do what you want with it as it is yours, you just can't go around pretending it is the Mona Lisa.
If you're going to argue that there is IP on server-side that is near enough false, most IP is on client side with art assets, music etc.


If copyright law would be like you think it is, it would be a construct with 7000 loopholes.. a joke itself, nobody would even bother trying to defend it if every other pleb can work around it. Just because the nost script is made from scratch its still blizzards intellectual property.

are you missing something?

Maybe all quests, mobs, items and npcs? Is that perhaps because those are all serversided? Please, go ahead and tell me Lady Sylvanas Windrunner, Tyrande Whisperwind, Ragnaros, Onyxia or Jaina Proudmoore arent part of blizzards IP.

The models/avatars for all of those characters, as well as their names, are contained in the .dbc files of the client that are property of Blizzard and accessed whenever a person launches his client.

The code contains the information on how the avatar will react when attacked, what abilities will it use, how much health it will have, if it drops any loot/rewards. The emulator code is built from scratch and given that it is not the patented code it's not subject to copyright law. The poster you're quoting is correct.

It is perfectly possible for anyone to build a code that mirrors Photoshop or Adobe Acrobat Reader in its functionality. So long as the names (registered trademarks) and the code used in the construction isn't taken from the offices/databases of Adobe, no law is being infringed. It is for this very reason that products that compete with each other, while mirroring each other in a gigantic amount of aspects, are still separate entities dettached from each other.

Software legislation is pretty simple to understand yet does take a moment to learn to separate concepts.

I recommend you apply for an internship in a legal firm that deals with copyright for some time, in order for you to understand how it actually works.
Without meaning to offend, the last line is something that shows how little you know about it.

Hey guys, don't mean to hijack your thread but another hosting thread of mine isn't getting any attention.

I took a look at Warmane and it appears they host their logon server at AWS NA (Amazon Cloud) and their gameservers at OVH (France), the later being where Nostalrius was hosted.

Why is Warmane fine and Nostalrius not?

As I tried to explain earlier. "We operate according to the Icelandic Laws, any law such as DMCA are not applicable here. Keep in mind that we do not listen to lawyers outside of Iceland."

France is another story.

France is another story.

Although it may be different in Iceland with copyright law, Nostalrius/OVH was also approached by French lawyers, not American ones, and DMCA wasn't used here either; it was a Cease&Desist based on French laws, not US ones.
