It's illegal in the states to do what the Nostalrius Devs have done in france.. Yes, they ceased it, and I'm no expert at law, but I'm pretty sure if they land in the states they can be arrested.

In it prudent to expect entirely bizzare behaviour from large organizations, including States. The Law is not in any way connected to what you and I would expect or consider rational, or even decent. Nothing would happen to them, the police would consider this a civil dispute not a criminal act, and thus handled by lawyers. The 1st step in any civil matter would be a cease and desist in these types of cases. To which Nostalrius complied.

it is also a matter if Blizzard wants to take further action on them yes or no.
in this case Blizzard invited them to come over, so it would be strange plus a kill to their own brand name if they were to take legal actions.

dialogue is better then kicking in the face...
